Legal Aspects of Data Spaces

This legal workshop will focus on some regulatory legal aspects of (setting up) data spaces. The workshop will depart from the potential legal issues and (practical) challenges data space initiatives may encounter and attempt to single out those that are most pressing for data space initiatives. Examples are the (unclear) roles in data spaces, the risk of unfair clauses following a power imbalance, data protection concerns or the lack of interoperability. A first part of the workshop looks at the answers included in (existing and new) regulatory frameworks, and will evaluate whether and how the identified gaps are remedied (‘by the law approach’). A second part will look at how contractual frameworks can/should deal with the identified gaps. It will thereby gauge the contractual needs and discuss best practices, while also establish areas where more guidance on the contractual side is required (‘by the contract approach’). The workshop will be interactive and also involve feedback by stakeholders prior to the event, for instance by identifying the pressing needs and challenges in practice.
